You must be at least 18 years of age and capable of entering into a binding contract under applicable Indian law to use the Platform or create an account.

By registering as a property owner, you represent that the information you provide is accurate, that you have the authority to list any property you submit, and that your use of the Platform complies with all applicable laws and regulations.

Property owner accounts are created through email verification using a one-time password (OTP). You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree to:

• Provide accurate and complete registration information
• Keep your account details up to date
• Notify us promptly of any unauthorised access or security breach
• Not share your account with others or create accounts for fraudulent purposes

We may suspend or terminate accounts that violate these Terms, contain false information, or are used in a manner that harms the Platform or other users.

You may use the Platform for lawful purposes only. You agree not to:

• Post false, misleading, or fraudulent property listings or enquiries
• Upload content that infringes intellectual property or privacy rights
• Harass, abuse, or harm other users or Property Manthra staff
• Attempt to gain unauthorised access to the Platform or its systems
• Scrape, copy, or commercially exploit Platform content without permission
• Use the Platform for spam, unlawful marketing, or prohibited activities

We reserve the right to investigate violations and take appropriate action, including removing content, rejecting listings, or terminating access.

Registered property owners may submit listings through the Platform. All listings are subject to review and approval by Property Manthra before they are published publicly.

By submitting a listing, you represent and warrant that:

• You own the property or are duly authorised to list it on behalf of the owner
• Listing details, images, videos, pricing, and location information are accurate
• Your listing does not violate any law, third-party right, or these Terms
• You will update or remove listings when they are no longer available or accurate

We may approve, reject, edit, unpublish, or remove listings at our discretion, including when content is incomplete, misleading, duplicated, or requires re-approval after material changes. A rejected or pending listing is not guaranteed publication.

You grant Property Manthra a non-exclusive, royalty-free licence to display, promote, and distribute your listing content (including text, images, and videos) on the Platform and in related marketing materials for the purpose of operating and promoting the service.

By registering as a property owner and agreeing to these Terms, you acknowledge and accept that Property Manthra may act as an intermediary in connecting property owners with prospective buyers, tenants, or investors through the Platform.

Commission: Where a transaction, lease, or successful introduction results from a listing published on the Platform or from an enquiry facilitated through Property Manthra, you agree to pay brokerage or commission fees as communicated by Property Manthra at the time of listing, during onboarding, or prior to completion of the transaction.

Unless otherwise agreed in writing, commission terms may include:

• A percentage of the sale or rental value, or a fixed fee, as applicable to the property type and transaction
• Payment upon successful completion of a sale, lease, or other agreed outcome
• Applicability to transactions with parties introduced through the Platform, enquiries received via Property Manthra, or buyers/tenants traceable to your listing on the Platform

You agree to cooperate in good faith with Property Manthra during enquiry handling, site visits, negotiations, and documentation. Withholding material information, bypassing the Platform to avoid commission, or completing a transaction with a Platform-introduced party outside the agreed process may constitute a breach of these Terms.

Specific commission rates, payment timelines, and exceptions will be communicated separately where required. In case of conflict between informal communications and these Terms, a written agreement signed by both parties will prevail.

Visitors may submit property or general enquiries through the Platform. Enquiry information may be shared with Property Manthra representatives and, where relevant, with the property owner or assigned agent for the listing concerned.

Property owners agree to respond to legitimate enquiries in a timely and professional manner and not to misuse contact details obtained through the Platform for unsolicited marketing or unlawful purposes.

Property Manthra does not guarantee that any enquiry will result in a visit, offer, or transaction.

Basic listing and account features may be offered at no upfront charge unless otherwise stated. We reserve the right to introduce or modify fees, premium features, or subscription plans with reasonable notice.

Brokerage and commission obligations under Section 6 are separate from any optional platform fees and remain payable as agreed when a qualifying transaction occurs.

The Platform, including its design, branding, software, text, graphics, and compiled content (excluding user-submitted listing content), is owned by or licensed to Property Manthra and protected by applicable intellectual property laws.

You may not copy, modify, distribute, or create derivative works from Platform materials without our prior written consent. You retain ownership of content you submit, subject to the licence granted in Section 5.

The Platform may integrate or link to third-party services such as map providers, analytics tools, or social platforms. Your use of those services is subject to their respective terms and policies. Property Manthra is not responsible for third-party services or content.

The Platform is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Property Manthra disclaims all warranties, whether express or implied, including fitness for a particular purpose and non-infringement.

We do not guarantee the accuracy, completeness, or availability of any listing, property condition, pricing, legal title, or transaction outcome. Users are responsible for conducting their own due diligence, legal verification, and independent professional advice before entering into any property transaction.

Property Manthra is a listing and facilitation platform and is not a party to agreements between property owners and buyers or tenants unless expressly stated in a separate written agreement.

To the maximum extent permitted by applicable law, Property Manthra and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Platform.

Our total liability for any claim arising out of or relating to these Terms or the Platform shall not exceed the greater of (a) the amount you paid to us for the relevant service in the twelve (12) months preceding the claim, or (b) INR 5,000, except where liability cannot be limited under applicable law.

You agree to indemnify and hold harmless Property Manthra from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Platform, your listings, your breach of these Terms, or your violation of any law or third-party rights.

We may suspend or terminate your access to the Platform at any time, with or without notice, if you breach these Terms, engage in fraudulent activity, or if continued access is harmful to the Platform or other users.

You may request account closure by contacting us at info@propertymanthra.com. Termination does not relieve you of obligations that accrued before termination, including commission or payment obligations under Section 6.

Our collection and use of personal information is described in our Privacy Policy, which forms part of these Terms.

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Material changes may be communicated through the Platform or by email where appropriate.

Continued use of the Platform after updated Terms are posted constitutes acceptance of the revised Terms, unless otherwise required by law.

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts at Palakkad, Kerala, India, unless applicable law requires otherwise.
